Terms & Conditions

Last updated: September 2026

These Terms & Conditions apply to services supplied by Stay Safe Compliance Pty Ltd (“Stay Safe Compliance”, “we”, “us” or “our”). By accepting a quotation, booking services, instructing us to proceed or otherwise engaging us, the customer agrees to these Terms & Conditions.

Services and Quotations

Stay Safe Compliance provides workplace compliance inspection, testing, servicing, reporting and related services. The services provided will be limited to the scope stated in the applicable quotation, proposal, work order or other agreement.

Quotations are based on information available at the time and may be adjusted where quantities, site conditions, access requirements or the required scope materially differ from what was originally provided. Unless otherwise stated, prices are exclusive of GST.

Additional work or attendances outside the agreed scope may be charged separately.

Customer Responsibilities and Site Access

The customer must provide accurate information and reasonable and safe access to the premises, equipment and work areas and advise us of relevant hazards, access restrictions, induction requirements and other site conditions.

The customer remains responsible for the ongoing operation, maintenance, condition and safety of its premises, equipment and systems and for taking appropriate action where faults, damage, deterioration or other issues become apparent.

Where work cannot reasonably proceed because of unavailable access, equipment, personnel or other customer-controlled circumstances, reasonable additional attendance or rescheduling costs may apply.

Testing, Inspection and Equipment Performance

Any inspection, test, service, pass result, tag, report, register or certificate issued by Stay Safe Compliance reflects the condition or test result of the relevant equipment, asset or system at the time the service was performed and within the limitations of the applicable inspection or testing method.

A satisfactory result does not constitute a guarantee or warranty that equipment will remain compliant, remain free from defects or operate successfully when subsequently required.

Equipment may fail or deteriorate after servicing due to wear and tear, damage, misuse, tampering, modification, environmental or operating conditions, inadequate maintenance, third-party work, manufacturer or latent defects, or other circumstances that were not present or reasonably identifiable when our service was performed.

To the maximum extent permitted by law, Stay Safe Compliance is not responsible merely because equipment previously inspected, tested or serviced by us subsequently fails, malfunctions or does not perform as intended.

This applies to electrical equipment, RCDs, fire and emergency equipment, emergency and exit lighting and other equipment within our service scope. A satisfactory inspection or test does not guarantee that equipment will successfully operate during a future fire, electrical incident, emergency or other event.

Periodic servicing does not constitute continuous monitoring. The customer remains responsible for ongoing maintenance, required service intervals and responding to any change in equipment condition between services.

Defects and Further Work

Where a defect, failed item, non-compliance or further work requirement is identified, we may record it in our report or otherwise notify the customer.

Unless expressly included in the agreed scope, rectification, repair, replacement or further testing is not included in the original service and may be quoted or charged separately.

The customer is responsible for taking appropriate action in response to defects or recommendations communicated by us.

Reports and Documentation

Reports, registers, certificates and other documentation are based on the work performed and conditions existing at the time of service.

They should not be interpreted as guarantees of future condition, compliance or performance and should only be relied upon for the purpose and scope for which they were prepared.

Subcontractors

Stay Safe Compliance may engage appropriately qualified, licensed or competent subcontractors or specialist providers to perform parts of the agreed services.

We may coordinate those services and associated documentation as part of the customer's engagement with Stay Safe Compliance.

Payment, Cancellation and Rescheduling

Unless otherwise agreed in writing, invoices are payable within 7 days of the invoice date.

Reasonable additional charges may apply where the agreed scope increases, additional attendances are required or site conditions differ materially from those disclosed.

Where a booking is cancelled or rescheduled without reasonable notice after we have allocated personnel, arranged subcontractors, commenced travel or incurred other costs, reasonable cancellation or attendance charges may apply.

Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

Subject to those rights and to the maximum extent permitted by law, Stay Safe Compliance is not liable merely because equipment, an asset or a system previously inspected, tested, serviced, tagged or reported on by us subsequently fails or does not perform as intended.

The fact that Stay Safe Compliance previously inspected, tested or serviced equipment does not of itself establish that Stay Safe Compliance caused or is responsible for a subsequent failure, fire, electrical incident, emergency, property damage or other loss.

To the maximum extent permitted by law, Stay Safe Compliance excludes liability for indirect, special or consequential loss, including loss of profit, revenue, production, business, contracts, opportunity or business interruption arising in connection with the services or subsequent equipment failure.

Where liability for services can lawfully be limited, our liability is limited, at our option, to supplying the relevant services again or paying the reasonable cost of having those services supplied again.

Nothing in these Terms & Conditions excludes liability where doing so would be unlawful, including liability arising from a failure by Stay Safe Compliance to exercise reasonable care and skill.

Privacy and Confidentiality

We handle personal information in accordance with our Privacy Policy and applicable privacy requirements.

We take reasonable steps to protect confidential information provided in connection with our services and may disclose information to personnel, subcontractors, professional advisers and service providers where reasonably necessary to provide or administer the services or where required by law.

General

These Terms & Conditions apply unless different terms are expressly agreed in writing for a particular engagement. Where another written agreement accepted by Stay Safe Compliance contains inconsistent terms, those specifically agreed terms apply to the extent of the inconsistency.

Stay Safe Compliance will perform its services subject to applicable Commonwealth, State and Territory laws and regulatory requirements relevant to the location and nature of the services.

If any provision of these Terms & Conditions is invalid or unenforceable, it will be read down or severed to the extent necessary without affecting the remaining provisions.

These Terms & Conditions are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.
